These are alternate assignments substituting for the video conference. Complete the following questions. The answers to the questions should be thorough to display complete understanding of the text and be at least 5 sentences. While some questions may seem opinion based, I will be looking for information from the text to confirm your learning.
When he was 16 years old, the defendant and another juvenile gunned down a man outside a Chicago park. The defendant did the shooting; the other juvenile handed him the gun. The other juvenile pled guilty to second degree murder and was sentenced to 17.5 years in prison. The defendant was tried for first degree murder and use of a weapon in the murder, and convicted by a jury. He was sentenced to 50 years in prison for the murder and 50 years for the weapon offense, the sentences to be consecutive. He would thus not be released until he was 117 or until he died. Does Miller v. Alabama require resentencing of the defendant? Why or why not? See McKinley v. Butler, 809 F.3d 908 (7th Cir. 2016).
A high school student did the following in a short period of time: (1) Asked a teacher what she would do if he came to school wearing a bomb vest; (2) drew a picture of a stick figure wearing a bomb vest, with the word “soon” written below the stick figure, and showed the picture to other students, and (3) in reply to a Facebook post by another student, who suggested he would bring a “blowup doll” to the prom, the student posted “fill the doll with 20 pounds of explosives.” Are these statements sufficient to constitute the crime of making bomb threats to persons or places?
