ntroduction and Thesis Statement
The government of Canada supposedly works tirelessly to correct the issues within the Indian act. To dispose of one of the most common issue within the Indian act being sex discrimination, they enacted Bill – C3. Some may argue that the Indian Act (Bill- C3) has provided Indigenous communities a constitutional relationship with Canada and that it grants the rights aboriginals are entitled too, but it has indefinitely flawed in providing equalities of sexes. This flawed constitutional relationship and constant battle for policy changes, lead to the many issues regarding the safety and rights of Aboriginal women. The Gender inequalities that appear in the Indian act have resulted in women’s rights being disregarded and the inability to prevent vulnerability and violence.
Outline and Structure
Heading 1 . Indian Act and adjustment delays
I wish to Discuss the Indian Act Itself and highlight the fact that the adjustment efforts of Bill – C3 to correct the sex discrimination didn’t solemnly stop it from occurring. The constitutional relationship between Canada and the Indigenous wasn’t completely entrusting, resulting in constant denial of the passing of Bill- C3 which negatively effected women and their gender role. Due to the new equality rights and freedoms the Canadian constitution brought fourth, something needed to be done to confront the sex discrimination amongst indigenous people. Bill – C3 was projected to cancel the sex discrimination that appeared on the Indian act. The Bill- S3 never ended up doing what is was projected to do but instead, still incorporated sex based hierarchy amongst indigenous men and women. The Indian Act was conducted in 1876 when times were much stereotypical, the women of this time were the second party to men. It was not until 1985 where the sex based hierarchy were truly acknowledged, but yet still ignored.
Heading 2. Gender Inequalities
I want to touch solely on the gender inequalities that are stated in the Indian Act and why they have caused several preventable issues from occurring such as, the serial murders of indigenous women, the high levels of domestic violence that occur in aboriginal homes, the amount of substance abuse, and lack of opportunity and education. The reason and cause for these types of issues to arise is because of indigenous woman ongoing power struggle to be equal to Indigenous men.
Heading 3. Relationship between Indigenous people and Canada
My Final paragraph of the essay will elaborate on the constitutional relationship between Canada and Indigenous communities, and the reason for the delay in altering and passing of Bill C-3. Also to argue that the relationship between the two is not compatible, and not functioning to the degree it should be.
